Terms and Conditions for Business
 

Welcome to Go Live, a service provided by HK Go Live Limited (“Go Live”, “we”, “us’, “our”). Please read the Terms and Conditions (“Terms”), our Privacy Policy and other terms referenced in this document carefully.

These Terms governs your use of Go Live’s services (“Services”), including our website and all associated features, functionalities, user interfaces, applications, and all content that is made available through the Services (“Content”). Content may be offered through Go Live Services or a third party.

These Terms, together with our policies and any other additional terms referred to on it, create a contract between you and Go Live (the “Agreement’).

Please read the Terms, Privacy Policy, and other referenced guidelines very carefully. If you wish to review the terms of the Agreement, the latest effective version of the Agreement is available on Go Live’s website.

Acceptance of Terms

In order to use Go Live Service and access any Content, you need to be over 18 years of age. If you are under 18 years old, you can only use our Services with your parent or guardian's consent to the Agreements.

By signing up or otherwise using any of the Go Live Services, you represent and warrant that you have read and understood the Agreements, accept these Agreements, and agree to be bound by them. If you don't agree with (or cannot comply with) the Agreements, you should not use Go Live Service or access any Content.

Changes to The Agreements

We reserve the right to change or modify the Agreement at any time without prior notice. Please make sure you visit the Terms and our policies from time to time. Your continued use of Go Live Services after any such alterations constitutes your, your parent or guardian’s consent. In case you do not wish to continue using the Service under the new version of the Agreement, you may terminate your account by contacting us.

Using Our Services

Subject to your strict compliance with these Terms and Usage Guidelines at any and all times during your use of Go Live Services, we grant you limited, non-exclusive, revocable, non-assignable and non-transferable permission to make personal and non-commercial use of the Content (collectively, “Access”). This Access shall remain in effect until and unless terminated by you or Go Live.

The Go Live Service and the Content are the property of Go Live or Go Live’s licensors. The Go Live applications and the Content are not sold or transferred to you, and Go Live and its licensors retain ownership of all copies of Go Live applications and Content even after installation on your personal computers, mobile devices, and other devices (“Devices”). To use our Services, you need compatible hardware, software (latest version recommended and sometimes required) and Internet access (fees may apply). Our Services’ performance may be affected by these factors.

Account

Using our Services and accessing the Content may require a Go Live account. When you sign up for a Go Live account, you should make sure any registration information that you submit to Go Live is true, accurate, and complete, and you agree to keep it that way at all times. If any of the personal data you provide is incorrect, outdated or misleading in any way, we reserve the right to suspend or terminate your account and your right to use Go Live services at any time.

In order to help you navigate and discover Content that interests you when using Go Live Services, the registered user will also receive auto-generated personalized recommendations of other Content based on your watching history or user profile.

Your account is valuable, and you are responsible for maintaining its confidentiality and security. Go Live is not responsible for any losses arising from the unauthorized use of your account. Please contact Go Live if you suspect that your account has been compromised.

You may terminate your account at any time by contacting us.

Data Protection and Privacy

You agree that Go Live is entitled to collect, use, keep and update your personal data in the course of our service delivery. All personal data that you provide to us associated with your use of Go Live Services is collected, stored, used, disclosed and other processed by Go Live in accordance with our Privacy Policy. You expressly consent that Go Live is entitled to transfer your personal data to stakeholders, including but limited to your ticket confirmation details, as may be necessary when Go Live provides the Services to you. We also use cookies to help us understand how people are using our Services for service improvements and development. Our user of cookies, and how to disable cookies, is further explained in our Privacy Policy.

Services and Content Usage Guidelines

Your use of the Services and Content must abide by the following rules set forth in this section (“Usage Guidelines”).

      1. You may use Go Live Services and Content only for personal, non-commercial purposes and that you will not redistribute or transfer Go Live Services or the Content.
      2. Go Live’s delivery of Services and Content does not transfer any commercial or promotional use rights to you, and does not constitute a grant or waiver of any rights of the copyright owners.
      3. Your activity associated with Go Live Services should be in accordance with the Terms and our Usage Guidelines.
      4. You shall be responsible for providing the proof of purchase upon the purchasers’ request, if necessary.
      5. You should respect Go Live, the owners of the Content, and other users of the Go Live Service.
      6. Copying, manipulating, “ripping”, “crawling”, redistributing, reproducing, recording, transferring, selling, performing or displaying to the public, or otherwise making use of Go Live Services or the Content without the permissions under the Agreements or applicable law, and may infringe the intellectual property rights, is prohibited.
      7. You must not engage in any activity that is offensive, abusive, defamatory, pornographic, threatening, obscene, or illegal.
      8. Any other conduct that we believe is inappropriate under due cause.

You acknowledge and agree to comply with the above conditions at any and all times during your use of Go Live Services. You understand that engaging in any activity that violates the User Guidelines may result in immediate suspension or termination of your Go Live account. You also agree that Go Live may reclaim your username for any reason. Please be thoughtful about how you use the Go Live Service and the Content that you share.

Purchase Terms

Go Live provides personalized services with social and interactive features for streaming performances and other content, products and services developed over time. Transactions may be occurred during your use of Go Live Services. You should contact Go Live or the event organizer regarding the rights and interests associated with the Services and Content, and follow the rules and instructions provided by us and the event organizer.

Make a Purchase

You should follow the instructions on our website when making a purchase. If you provide incorrect information or conceal true information, the payment or transaction may fail. Consequences include unsuccessful processing of ticket purchase, event admission, and ticket refund. Unless you are able to provide proper supporting for the information processing, you shall be solely responsible for any consequences resulted from the unsuccessful transaction.

Payment Confirmation

  1. You should always confirm the content of your purchase carefully before making the payment transactions.
  2. The person making the purchase shall be the same as the personal making the payment transaction. In case of any dispute, the person making the purchase shall be the actual person making the payment transaction.
  3. During the payment transaction processing, please be patient and do not exit the authorization processing webpage or turn off your device, until the entire payment transaction process is completed.
  4. You can review your completed purchase through your Go Live account or auto-generated transaction confirmation email.

Tickets Collection

You shall receive your electronic ticket by logging in your Go Live account or checking the confirmation email. All tickets are valuable instruments. Please keep your tickets with due care and should abide with the Terms and rules of the Content provider regarding your rights and obligations.

Events Admission

  1. You shall arrive the performance venue or enter the online performance platform on time with your valid event tickets or access code. The requirements of venues may vary. You should confirm the event details with the Content provider in advance to avoid confusion and be responsible for any consequences.
  2. Each individual should hold one electronic ticket or access code for event admission. For on-site events, each electronic ticket can only be scanned once. For online performances, each access code only be available on one device. Any copies or forwarded tickets are void. The validity of the ticket or code is determined by the verification systems of the event provider or Go Live. The event provider shall have the ultimate right of the determination.
  3. If you purchased tickets with special requirements, please present the relevant identification documents. If you fail to provide such documents, the event or Content provider may refuse your admission to the event or the Content.

Tickets Cancellation, Exchange and Refund

No tickets or ticket package cancellation is allowed after the payment transaction is completed. Any sold tickets or processed transactions are non-refundable and non-exchangeable, unless any alterations are done by the Content provider after such transaction, and such ticket or payment refund may be permitted after discussions between Go Live and the Content providers.

Refuse or Terminate of Use

If you engaged in any of the following conditions, Go Live has the right to suspend or terminate your use of Go Live Services and access of the Content.

      1. Any failure in completing the payment transaction process.
      2. Any abnormal or unusual ticketing activity.
      3. Any activity that violates any laws and regulations, such as resale of ticket for earning profits.
      4. Any activity that violates the Terms and rules of the Content provider.

Customer Dispute Resolution

For support with event or content related issues, please refer to the event or Content webpages and contact the event or Content provider.

For customer support with account or payment-related issues, please complete the Contact Form on the Contact Us section of our website. We will respond to Customer Support enquires within a reasonable time frame but we make no promise to response the enquires within any particular time frame or answer each and every enquiries.

Rights You Grant Us

Your Usage

In consideration for the right granted to you under the Agreement, you grant us the following rights:

      1. To use the processor, bandwidth, and application on your Devices for the operation of the Service.
      2. To advertise or promote Content or other information to you.
      3. To allow our business partners to do the same. The Content and placement selection may be influenced by commercial considerations, including, Go Live’s agreements with third parties.

User-Generated Content

You may engage, submit, post, upload or otherwise contribute content to the Service, including, but not limited to text, messages, information, comments, rating and reviews, or other types of content (“User content”). You own the intellectual property right, such as copyright in any such content. However, you consent to give us legal permissions (“License”) to use such content for product development and service improvements purposes. You (or someone on your behalf) shall also ensure that you own or have obtained necessary authorizations to grant the licenses and rights that you grant to us. You promise that, with respect to any of your User Content post on Go Live, you are solely liable for such User Content, and the User Content must comply with the Terms and Usage Guidelines. If you come across materials that do not comply with such rules, please contact us.

You hereby acknowledge the User Content is not confidential and specifically when the content you create, upload, or share is covered by intellectual property rights, you grant Go Live a royalty-free, perpetual, non-exclusive License to use the materials you contribute within the Services without restrictions.

Go Live may, but has no obligation to, monitor, review, or edit User Content. In all cases, Go Live reserves the right to remove or disable access to any User Content for any or no reason, including the violation of the Agreement, without prior notice.

Personalized Recommendation Features

The Services may recommend Content to you based on your purchases and other activities. You may opt out from receiving such personalized recommendations for some Services in your account settings at any time.

Some recommendation features may require your permission before they are turned on. If you turn on these features, you will be asked to give Go Live the permission to collect and store certain data, including but not limited to data about your device activity, location, and usage. Please carefully read the information presented when you turn on these features.

Disclaimer

Go Live shall use reasonable efforts to protect your rights and information in connection with the Services, but Go Live and all content providers do not guarantee, represent, or warrant that your use of the services will be uninterrupted or error-free, and you agree that at any time Go Live may suspend, discontinue, terminate, or cease providing Go Live Services, temporarily or permanently. If any of the circumstances occurs, Go Live shall use its reasonable endeavours to notify the registered users of such decision in advance.

You acknowledge and agree that your use of, or inability to use, or activity in connection with the services is at your sole risk. The Services and all Content delivered to you through Go Live are (except as expressly stated by go live) provided "as is" and "as available" for your use, without warranties of any kind, either express or implied, including all implied warranties of the availability and quality of the Services and Content or the compatibility of the application with your device.

Go Live shall use reasonable efforts to protect your rights and information in connection with the Services, but Go Live and Content providers does not represent or guarantee that the Services will be free from loss, corruption, attack, viruses, interference, hacking, or other security intrusion, and you hereby release Go Live from any liability relating thereto. You shall be responsible for backing up your own system, including any content acquired through the services. Go Live is not responsible for any data charges that you may incur in connection with your use of the Services.

You understand that in no case shall Go Live, its directors, officers, employees, affiliates, agents, contractors, licensors, or shareholders be liable for any direct, indirect, incidental, punitive, special, or consequential loss or damages arising from your use of any of the Services or for any other claim related to your use of the services or content, including, but not limited to, any errors or omissions in any content, or any injury, loss or damage of any kind incurred. You hereby release Go Live from any and all liability to you for any loss or liability relating to such circumstances in any way.

The foregoing limitations and exclusions apply to the extent permitted by law.

Waiver and Indemnity

By using the Services, you agree, to the extent permitted by law, to indemnify and hold Go Live, its directors, officers, employees, affiliates, agents, contractors, licensors, and shareholders harmless with respect to any claims arising out of your breach of this agreement, your use of the services, or any action taken by Go Live as part of its investigation of a suspected violation of this agreement or as a result of its finding or decision that a violation of this agreement has occurred. You agree that you shall not sue or recover any damages from Go Live, its directors, officers, employees, affiliates, agents, contractors, licensors, and shareholders as a result of its decision to remove or refuse to process any information or content, to warn you, to suspend or terminate your access to the services, or to take any other action during the investigation of a suspected violation or as a result of Go Live’s conclusion that a violation of this agreement has occurred. This waiver and indemnity provision applies to all violations described in or contemplated by this agreement.

Applicable Law and Jurisdiction

The Terms shall be governed by and constituted in accordance with the laws of Hong Kong.
